- Garrett James Smith, 22, of Oldsmar, Fla. was sentenced to six months probation and a $450 fine after running away from a protest in support of a Jan. 6 rioter.
- Prosecutors chose not to pursue the charges after the Bureau of Alcohol, Tobacco, Firearms, and Explosives determined the incendiary items Smith was carrying were smoke devices and not explosives.
- At the time of the arrest, Hillsborough County Sheriff’s Office and FBI Tampa’s bomb technician had confirmed the pipe-style item was indeed an active explosive device.
