Gary Phillipo II, 46, of Carver, Mass., faces hate crime and assault charges after allegedly attacking a Black man outside a Cumberland Farms in Kingston on Sept. 8. Police said the victim was standing near the gas pumps when Phillipo began yelling racial slurs, then charged at and assaulted him without provocation.
The victim suffered multiple injuries, including a suspected compound fracture. Police said witnesses corroborated his account, and surveillance video obtained from the store appeared to support investigators’ findings.
Phillipo was charged with assault and battery with a dangerous weapon causing serious bodily injury, assault and battery to intimidate resulting in bodily injury as a hate crime, and disturbing the peace. Police said that after being taken to a hospital for an injury, he also allegedly yelled profanity and racial slurs and made sexual comments to hospital staff. Phillipo was held following arraignment and is scheduled to return to court next month.
